- Purpose and Scope
This Acceptable Use Policy (“AUP”) governs the use of SMS/MMS messaging services provided by Junction Networks, Inc., dba OnSIP (“OnSIP”). For purposes of this AUP, “Customer” includes any individual or entity using OnSIP’s messaging services.
Customer must comply with all applicable laws, carrier requirements, and industry standards, including but not limited to the CTIA Messaging Principles and Best Practices, the Telephone Consumer Protection Act (“TCPA”), and Federal Communications Commission (“FCC”) regulations.
This AUP does not provide legal advice. It is strongly recommended that you consult your own legal advisor to address any other applicable policies, regulations, and laws. In the event of any conflict between this AUP and applicable law, the applicable law shall prevail.
- Definitions
- “Consent” means express, written agreement from the recipient to receive SMS/MMS messages.
- “Opt-Out” means a recipient’s request to stop receiving messages, submitted via recognized keywords.
- “Automated Messaging” means messages sent by systems without direct human intervention.
- “Campaign” means a specific set of messages with a common purpose or topic.
- Message Volume Limits
While OnSIP offers unlimited messaging with associated costs, Customer is subject to carrier and regulatory requirements and limitations. Customer may send no more than 50 messages per originating number per minute and 2,000 messages per originating number per day. These limits are subject to change, without notice, based on carrier or regulatory requirements.
- Toll-free Messages
Toll-free numbers can be used for both SMS and MMS. Customer may send no more than 50 messages per originating number per minute and 2,000 messages per originating number per day. These limits are subject to change, without notice, based on carrier or regulatory requirements. Toll-free numbers are supported in the USA and most NPA/NXXs in Canada. See Section 10 below for certain NPA/NXX limitations, which are subject to change without notice.
- Consent and Registration
- Customer must obtain express, written consent from each recipient before sending any marketing, promotional, or informational messages.
- Consent must be specific to each campaign or message type and must be logged and retained.
- Customer must complete registration with The Campaign Registry (“TCR”) before sending SMS messages.
- Opt-Out Requirements
- Every informational, marketing, or promotional message must include clear opt-out instructions.
- Opt-out requests must be honored immediately.
- Customer must log and track all opt-ins and opt-outs, and produce these logs upon request by carriers or OnSIP.
- For long-code and toll-free SMS do not manage opt-outs. Customer is solely responsible for managing opt-outs manually.
- Automated Messaging
- Automated messages must be sent only from numbers associated with a TCR campaign designated for automated messaging.
- Automated promotional messages must include opt-out language in every message.
- Prohibited Campaigns and Businesses
The following campaigns and business activities are strictly prohibited:
- SHAFT content: Sex, hate, alcohol, firearms, tobacco (including vape/e-cigs).
- Drugs, including prescription drugs.
- Marijuana/cannabis and CBD/THC, even if legal under state law.
- High-risk financial services, including offers for loans, mortgages, credit repair, debt relief, debt collection, cryptocurrency, tax relief, investment opportunities, and “get rich quick” schemes.
- Work-from-home, secret shopper, multi-level marketing, network marketing, or similar opportunities.
- Political advertisements and messages.
- Gambling, sweepstakes.
- Affiliate/lead generation.
- Buying, selling, or sharing opt-in lists or phone numbers.
- Any business or campaign with characteristics similar to the above examples.
The above items are only examples of prohibited campaigns and businesses. OnSIP reserves the right to edit the above list and to otherwise restrict usage as it deems appropriate, in its sole discretion.
- Prohibited Content
Messages containing the following content are strictly prohibited and may result in service being blocked or suspended by carriers or OnSIP:
- Any illegal activity.
- Pornographic or adult entertainment, even if legal.
- Violence, hate speech, threats, harassment, defamation, deception, or fraud.
- References to controlled substances, including marijuana/cannabis or kratom.
- Third-party affiliate/lead generation links.
- Obfuscated or misleading links.
- Attempts to evade OnSIP policies or carrier rules.
- Misspelling to evade filters.
OnSIP reserves the right to update this list or prohibit additional content at its discretion.
- Customer Responsibilities
Customers who use OnSIP SMS/MMS services must:
- Abide by this AUP, as well as all relevant laws, carrier guidelines, and industry standards.
- Obtain clear, documented permission from each recipient before sending messages. Consent should be specific to each campaign or message type and retained as required.
- Process opt-outs immediately. Keep accurate records and ensure that no further messages are sent to those who have opted out.
- Review message content. Ensure all outgoing messages comply with restrictions on prohibited content and campaigns, and avoid sending misleading, fraudulent, or illegal messages.
- Safeguard customer information, including phone numbers and consent/opt-out logs, in line with privacy laws and OnSIP’s requirements.
- Monitor changes to this AUP, carrier requirements, and applicable regulations. Adjust practices as needed.
- Promptly respond to any requests from OnSIP or carriers for information, documentation, or compliance actions.
- Only send messages to recipients in the United States and Canada. Sending messages to recipients in other countries is prohibited. Within Canada, OnSIP does not support sending messages to the following NPA/NXXs:
- NPA 354: 205, 206, 207, 208, 209, 210, 212, 214, 215, 216, 217, 218, 219, 220, 221, 224, 225, 226, 241, 242, 245
- NPA 438: 218
Failure to fulfill these responsibilities may result in suspension or termination of service, fines, or other penalties.
- Data Privacy and Security
- Customer data (e.g., phone numbers, consent logs, opt-out logs) must be stored securely and used only for authorized purposes.
- Data must not be shared with third parties except as required by law.
- Compliance with applicable data privacy laws (e.g., CCPA, GDPR, PIPEDA) is required.
- Enforcement and Penalties
Accounts in violation of OnSIP or carrier rules may face reduced deliverability, additional registration requirements and fees, suspension, termination, fines, or other penalties.
- Enforcement and Compliance Monitoring
OnSIP reserves the right to monitor messaging activity for compliance with this AUP.
In OnSIP’s sole discretion, violations of this AUP may result in a written warning and remediation request, temporary suspension of messaging privileges, and/or termination of messaging services.
In the event OnSIP incurs any fines, penalties, assessments, or other charges arising from violations of SMS/MMS messaging regulations, including but not limited to the TCPA, CTIA guidelines, or carrier-imposed rules, such costs shall be passed through to the Customer. Customer agrees to indemnify and reimburse OnSIP for all such amounts, including any associated legal fees.
